Terms and Conditions for Fleurop AG's Monthly Instagram Giveaways

Promotion Period

Fleurop AG generally runs one giveaway per calendar month on Fleurop Germany’s official Instagram account, @fleurop.de.

Each giveaway begins at the time specified in the corresponding Instagram giveaway post and ends at 12:00 noon on the last calendar day of the respective month.

The exact entry period will also be stated in the relevant giveaway post. The decisive factor is the time at which the comment is published on Instagram.

Comments submitted outside the entry period specified in the giveaway post cannot be considered when selecting the winner.

Eligibility

The giveaway is open to all natural persons who are at least 18 years old at the time of entry and are resident in Germany.

Employees of Fleurop AG, as well as employees of companies and service providers directly involved in the conception, organisation or administration of the respective giveaway, are excluded from participation. Members of their families who live in the same household are also excluded.

Participants may enter only on their own behalf. Sweepstakes clubs, automated giveaway services, and commercial or automated entries are not permitted.

How to Enter

To enter a monthly giveaway, participants must:

1. follow the official Instagram account @fleurop.de; and
2. comment, within the applicable entry period, on the Instagram post that is expressly identified as a giveaway.

The required content of the comment may be described in more detail in the relevant giveaway post.

As a general rule, only one entry per person and giveaway will be considered. Multiple comments by the same person on the same giveaway post will not increase their chances of winning unless the relevant giveaway post expressly states otherwise.

Entry is free of charge and is not conditional upon the purchase of any goods or the use of any services.

At the time of the draw, the participant’s Instagram profile must be configured in such a way that Fleurop AG can verify that the entry requirements have been met.

Disqualification

Fleurop AG reserves the right to exclude participants from the respective giveaway where there are reasonable grounds to suspect manipulation, automated participation, prohibited multiple entries or a breach of these Terms and Conditions.

Participants may, in particular, be excluded if:

• false information is provided;
• multiple Instagram profiles are used to circumvent the entry limit;
• bots, scripts or other automated methods are used;
• comments violate applicable law, accepted standards of decency or the rights of third parties;
• insulting, discriminatory, violent, offensive or promotional content is published; or
• an attempt is made to influence the selection of the winner in any other way.

In such cases, prizes that have already been awarded may subsequently be withdrawn and reclaimed.

Prize

The monthly giveaway will generally award a bouquet of flowers from Fleurop AG.

The specific prize will be described and shown in the relevant Instagram giveaway post. The flowers actually delivered may differ from those shown in the giveaway post, particularly due to seasonal or regional availability. However, the overall character and value of the prize will be maintained.

The prize cannot be paid out in cash, exchanged or transferred to another person. The prize may not be resold commercially.

The prize can be shipped or delivered only to a valid delivery address within Germany.

Should Fleurop AG be unable to provide the announced prize for reasons beyond its control, it reserves the right to provide a substitute prize of equivalent value.

Winner Selection

The winner will be selected at random from among all participants who have fulfilled all entry requirements within the relevant entry period.

The draw will generally take place on the last calendar day of the respective month after the entry period has ended.

Entries that do not comply with these Terms and Conditions or that are submitted after the entry deadline will not be considered in the draw.

Winner Notification and Acceptance of the Prize

Following the draw, the winner will be notified exclusively by Instagram direct message from the official Instagram account @fleurop.de.

Fleurop will not contact winners from an additional or newly created Instagram account and will never ask them to provide payment, bank account or credit card details.

The winner must respond to the direct message within 48 hours of the winner notification being sent and must provide all contact details required for delivery.

If no response is received within this period, the winner’s claim to the prize may be forfeited. In this case, Fleurop AG is entitled to select a new winner.

If the prize cannot be delivered due to incomplete or incorrect contact details, the winner’s claim to the prize may also be forfeited. Winners are responsible for ensuring that the contact details they provide are correct.

Modification and Early Termination

Fleurop AG reserves the right to modify, terminate prematurely or temporarily suspend a giveaway for good cause.

Good cause exists in particular where the proper conduct of the giveaway can no longer be guaranteed for technical, legal or practical reasons. This may include, for example, technical malfunctions, attempts at manipulation, outages of Instagram, or changes to the applicable legal framework.

In the event of any modification or termination of the giveaway, Fleurop AG will give due consideration to the legitimate interests of the participants.

Liability

Fleurop AG shall have unlimited liability for damages caused intentionally or through gross negligence, as well as for damages resulting from injury to life, body or health.

In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typically arising from such a breach. Essential contractual obligations are those obligations whose fulfilment is necessary for the proper conduct of the giveaway and on whose compliance participants may regularly rely.

In all other respects, Fleurop AG's liability shall be excluded to the extent permitted by law.

Fleurop AG does not guarantee the continuous technical availability of Instagram or the relevant giveaway post.

Data Protection

For the purpose of organising and administering the giveaway, Fleurop AG processes participants' personal data.

This may include, in particular, the following information:

• the publicly visible Instagram username;
• the submitted comment;
• information confirming whether the participant follows the Instagram account @fleurop.de;
• the contact and delivery details provided in the event of winning; and
• any additional information required for the delivery of the prize.

The data will be processed exclusively for the organisation, administration and execution of the respective giveaway and for the delivery of the prize. Participation in the giveaway will not, by itself, result in the use of personal data for marketing purposes or subscription to a newsletter.

As a general rule, the data of participants who do not win will not be stored outside Instagram. The personal data collected from winners during the prize fulfilment process will be deleted as soon as it is no longer required for the administration of the giveaway and provided that no statutory retention obligations apply.

Participant Content and Third-Party Rights

Comments published by participants must not contain unlawful, offensive, discriminatory, misleading, violence-promoting, objectionable or promotional content.

In particular, participants must not publish any content that infringes copyrights, trademark rights, personality rights or any other rights of third parties.

Fleurop AG is entitled to delete comments that are unlawful or violate these Terms and Conditions, report them to Instagram, and exclude the respective participant from the giveaway.

Release of Instagram

The respective giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta.

All questions, comments or complaints regarding the giveaway must be directed exclusively to Fleurop AG and not to Instagram or Meta.

Fleurop AG is the sole recipient of the information provided by participants in connection with the giveaway.

To the extent permitted by law, participants release Instagram and Meta from any claims arising in connection with the organisation of or participation in the giveaway.

Exclusion of Legal Recourse

Legal recourse is excluded with regard to the conduct of the draw and the determination of the winner.

Participants' statutory rights remain unaffected.

Applicable Law

These Terms and Conditions shall be governed by the laws of the Federal Republic of Germany.

For consumers, this choice of law shall apply only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

Final Provisions

Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

The relevant statutory provisions shall apply in place of the invalid provision.
